CHILD SUPPORT MODIFICATION

Child support payments can be modified at any time, with evidence of change in circumstances. The party requesting the change must file an order with the courts requesting the change in child support payment.  Issues previously addressed through the courts do not normally gain attention again unless there are dramatic changes and supporting evidence different from the previous hearing.  It is important to intervene prior to payments getting to far in arrears.  Courts rarely forgive money owed for support. 

Some factors for consideration of modification are:

·         Income of new spouse or live-in partner

·         Health conditions of child
·         Change in physical, mental  or emotional health of child
·         Remarriage of a parent
·         Receipt of inheritance, pension or other gift
